Social Security and General Healthcare Insurance Right of Working Children

Social insurance for children working for various reasons in-line with the regulations of the Turkish Labour Code, is being regulated in the Social Insurance and General Health Insurance Law No. 5510.

Accordingly, work accident, occupational disease and sickness insurance branches are applied to candidate apprentices, apprentices and students receiving vocational training in enterprises.

On the other hand, work accident and occupational diseases social insurance branch is being implemented for students who are subject to internship while studying at vocational high schools or during their higher education and students who are employed part-time, whose monthly premium earnings amount is not more than thirty times the lower limit of daily premium earnings (gross daily amount of the minimum wage).

These people are considered insured under the status of a service contract, and general health insurance provisions also apply to those who are not dependents.

In addition, those who are under the age of 18, among those who are required to be insured in their own name and account, independent worker and public servant status, are considered insured after the age of 18.

There is no requirement for those who have graduated from a vocational or art school to be over 18 years of age to work in positions related to their education, provided that they are deemed adults by the court in accordance with the provisions of the Turkish Civil Code. In this regard, the general rule is being accepted as child worker or young worker in accordance with the Turkish Labour Code No. 4857 as working under a service contract or an employment contract.

According to the Labor Code No. 4857, it is prohibited to employ children under the age of fifteen. However, children who are fourteen years old and have completed primary education can be employed in light work that will not hinder their physical, mental and moral development and the attendance of those who continue their education in school. Children employed in this way must be reported to the Social Security Institution, subject to the full short and long-term insurance branches defined in Law No. 5510.
