Temporar incapacity allowance is one of the social insurance benefits provided for employees within the Turkish Social Insurance System.
The term “Temporary incapacity for work” refers to the temporary inability of the insured to work during the medical rest period specified in the reports of the physician or health board authorized by the Social Security Institution (SSI) in cases of work accident, occupational disease, illness and maternity.
Temporary incapacity allowance, on the other hand, refers to the monetary assistance regulated by the Turkish Social Security Regime and paid by the SSI to the insured person who is at medical rest from work accident, occupational disease, sickness and maternity insurance branches. The allowance is paid for days off from work as to compensate the loss of income in the insured.
At What Rates Is Temporary Incapacity Allowance Payable?
Provided that a rest report is obtained from the physician or health committee authorized by the Institution, temporary incapacity allowance is being paid daily to the insued person who is incapacitated due to a work accident or occupational disease. In the cases of illness the allowance is being paid as to start from the third day of incapacity, however in cases of work accident and occupational diseases the allowance shall be paid as to start from the first day of incapacitation.
The temporary incapacity allowance to be given in case of work accidents and occupational diseases is
- Half of his/her daily income in inpatient treatments,
- In outpatient treatments, it is two-thirds of the daily income.
However, in case of work accident and occupational disease, temporary incapacity allowance is paid to the insured who are subject to 4/b insurance status (insured who are working on thir own name and behalf), during the inpatient treatment or during the period they receive a rest report as a requirement of this treatment after the inpatient treatment.
What are the Conditions to Benefit from the Temporary Incapacity Allowance?
Factors such as a certain insurance period, number of premium payment days and age are not included among the conditions of benefiting from temporary incapacity allowance paid as a result of work accidents or occupational diseases. In the event that the insured person, whose quality of insurance continues, becomes incapacitated as a result of a work accident or occupational disease, temporary incapacity allowance is paid by the Institution for each day of incapacitation.
However, in order to benefit from the temporary incapacity allowance for the 4/b insured persons and the insured persons who work in agriculture and forestry works on an intermittent basis with a service contract, all kinds of premiums and premium-related debts, including the general health insurance, must be paid.
