The primary regulations regarding occupational health and safety measures to be followed in workplaces in Türkiye are determined by the Occupational Health and Safety Code No. 6331, which was enacted in the year 2012.
One of the obligations imposed on employers by the Article 10 of Law No. 6331 is to conduct an assessment to identify risks related to occupational health and safety in workplaces. Accordingly, the employer is obliged to conduct or have conducted a risk assessment in terms of occupational health and safety.
While conducting a risk assessment, the necessary medical, technical and scientific controls, measurements and researches must be conducted to identify occupational health and safety risks that exist in the workplace, work environment and work processes.
The following issues must be specifically taken into consideration when conducting a risk assessment:
- The status of employees who will be affected by certain risks.
- The selection of work equipment, chemical substances and preparations to be used.
- The organization and order of the workplace.
- The status of groups requiring special policies such as young, elderly, disabled, pregnant or breastfeeding employees and female employees.
The employer must determine the occupational health and safety measures to be taken and the protective equipment or gear to be used as a result of the risk assessment to be made and provide them to the worker without any charge.
Occupational health and safety measures, working methods and production methods to be applied in the workplace must increase the level of protection of employees in terms of health and safety and must be applicable at every level of the administrative structure of the workplace.
The employer must ensure that the necessary controls, measurements, examinations and research are carried out in order to determine the risks to which employees are exposed in this environment and in terms of occupational health and safety.
