Employers’ Obligation to Cooperate in the Field of Occupational Health and Safety

The Occupational Health and Safety Code No. 6331, which is the primar legislation of the Turkish occupational health and safety regime, is the fundamental law that determines the minimum health and safety conditions in Türkiye that must be present in workplaces within the scope of the law.

One of the obligations introduced by the Code No. 6331 is the obligation to provide special regulations regarding occupational health and safety in cases where employees of more than one workplace work in the same field or together.

According to the law, employers are obliged to cooperate in the implementation of occupational hygiene and occupational health and safety measures in cases where more than one workplace shares the same work area or employees are working together.

Considering the nature of the work performed, the employers carry out the work to prevent occupational risks and protect themselves from these risks in coordination and inform each other and employee representatives about these risks.

According to the law, in places such as business centers, malls, industrial zones or sites where more than one workplace is located and operating together, coordination regarding occupational health and safety must be provided by the management of the place. The management of such places warns employers to take the necessary precautions regarding occupational health and safety hazards that may affect other workplaces. Likewise, the management of such places is obliged to report employers who do not comply with these warnings to the Ministry of Labor and Social Security.

In sum, according to the Turkish Occupational Health and Safety Legislation, if several workplaces are existing in the same working area or workers of different workplaces are working together, the employers of these employees should cooperate in the area of occupational health and safety. If the workplace is located in a business site or campus such as malls, the management of the facility is obliged to control and supervise the implementation of occupational health and safety of each workplaces.
