In Türkiye, employers have a key responsibility to report the employment of foreign workers under the Turkish Social Insurance System. This involves submitting a declaration confirming the insured status of their employees. For those classified as insured according to the Article 4(a) of the Social Security and General Health Insurance Code No. 5510, this declaration must be filed through the e-declaration system at least one day before the employee’s first day of work. The onus is on the employer to complete this online submission to the Social Security Institution.
While the standard rule is to submit this declaration one day prior to the employee starting work, there are specific situations where the timeline differs: For employees in construction, agriculture, or fishing, the declaration must be filed at the latest on the actual day they begin work.
For workers engaged in voyages with transportation vehicles heading to foreign destinations, the declaration is due within one month of their hiring date at the latest.
If a workplace is registering with the Social Security Institution for the first time, the declaration for new hires must be submitted within one month of the workplace’s registration date.
Work Permit Notifications for Foreign Nationals
When it comes to foreign workers who require a work permit, the deadlines for declarations are a bit different and hinge on the validity of the work permit:
The declaration for foreign nationals must be submitted within 45 days of the start date indicated on their physical work permit.
If the notification date of the work permit differs from the validity date, the employer must submit the declaration within 45 days of the notification date.
Starting from April 11, 2014, all declarations must be made within 30 days based on the validity date of the work permit.
