One of the rights defined for workers in the Turkish Labour Code No. 4857 is the right to annual paid leave.
Accordingly, workers who have worked in the workplace for at least one year have the right to annual leave between 14 and 26 days, depending on their seniority, the job they do and their age. This leave is paid and the wages belonging to the annual leave period should be given in advance to the employee.
Employees can continue to work at their workplaces after retirement. Annual leave entitlements of retired employees are calculated just like regular employees.
However, if the person leaves the job by terminating the employment contract due to retirement while working at the workplace, the leave right will be reset by paying the wage for the unused annual leave rights on the date of termination according to the Code No. 4857.
Thus, in this context, the seniority to be used as the basis for calculating the annual leave period after retirement is started from scratch, as if the worker have started working for the first time, without taking into account your previous work. For this reason, people who retire while working at the workplace must work for at least one year in order to be entitled to annual leave again.
