The Act No. 7464 is being published in the Turkish Official Gazette dated 2 November 2023. The provisions of the Article 20 of the relevant law have regulated the details regarding the payment of bonus of 5 thousand Liras to the retirees specifically for the 100th Anniversary of the Republic of Turkey, which has been previously announced to the public by the President.
In this context, with the law in question, the Provisional Article 98 has been added to the Social Insurance and General Health Insurance Code No. 5510. Accordingly, 5 thousand Turkish Lira bonus payments to retirees will be made according to the following principles:
In the October 2023 payment period, a single bonus payment of 5 thousand Turkish Liras will be made on a file basis to retirees who receive income or monthly payments.
The following rates will be taken as basis in making the payment:
– Permanent disability degree rate on which income is based for those who receive permanent disability income from work accidents and occupational diseases insurance branch.
– Ratio of shares of rights holders.
– Among those who died while being subject to permanent incapacity income due to losing less than 50% of their earning capacity in the profession as a result of a work accident or occupational disease, the share ratio of the beneficiaries based on the degree of permanent incapacity on which income is based on the insured person, whose death is not due to a work accident or occupational disease.
– The ratio of the number of premium payment days subject to our country’s legislation to those who receive partial income or pension in accordance with social security agreements concluded with foreign countries, to the total number of premium payment days taken into account according to the social security agreement.
In this context, retirees who receive income and pension from more than one file will be paid through a file that allows the highest payment.
There will be no additional bonus payment for those who continue to work in October 2023 while receiving income or salary. Thus, the 5 thousand Turkish Lira bonus payment will be paid only to retirees who do not work after retirement. However, it is possible for retirees who receive death benefit and pension to be paid even if they work.
No deductions can be made for debts from the bonus payment of 5,000 TL, and these bonus payments cannot be seized.
Payments that are later found to have been made incorrectly or inappropriately will be taken back by deducting 25% from the income or pension of the relevant person, if any, or if he/she does not have a pension, in accordance with general provisions.
The amount required to cover the payments to be made will be paid to the Social Security Institution by the Ministry of Finance and Treasury, upon written request, without a separate invoice.
