Obligation of Vocational Training Certification for Certain Employees

According to the Occupational Health and Safety Act No. 6331, it is mandatory for employees who will work in certain jobs to receive vocational training and to have the relevant professional competence certification. In this context, the procedures and principles of the vocational training of those who will be employed in hazardous and very dangerous jobs have been determined by the Regulation on the Vocational Training of Those to be Employed in Hazardous and Very Hazardous Class Jobs. Persons who will actually be employed in the jobs listed in ANNEX-1 of the aforimentioned regulation are required to have a vocational training certificate appropriate to the job they will do.

Documents accepted as valid within this framework are enlisted in the Article 6 of the aforimentioned regulation. Likewise, the institutions and organizations from which these documents can be obtained are also stated in the same article.

In addition, by amending the Vocational Qualifications Institution Law No. 5544 with the 74th article of the Law on Amendments to the Occupational Health and Safety Law No. 6645 and Certain Laws and Decree Laws, a vocational training certificate has become mandatory for jobs determined in accordance with the Law No. 5544.

With the mentioned amendment, in order to determine the professions that require a Professional Competence Certificate, communiqués for different professions have been published in the form of the Communiqué on Professions Requiring a Professional Competence Certificate. For the professions whose notifications are published within this framework, it is mandatory to receive vocational training in order to do this profession. The educational documents accepted to work in these professions are as follows:

  • Mastery certificate obtained in accordance with the Vocational Education Law No. 3308
  • A diploma obtained from vocational and technical education schools affiliated to the Ministry of National Education and from the relevant field of schools and departments of universities providing vocational and technical education, or a professional certificate approved by the Vocational Qualifications Authority (VQA) in the relevant field.

If a profession in the ANNEX-1 List of the Regulation on Vocational Training of Those to be Employed in Hazardous and Very Hazardous Classes of Work is included within the scope of the vocational qualification certificate obligation by publishing the National Vocational Standard, it becomes mandatory to obtain a VQA approved vocational training certificate in order to do this profession.

On the other hand, in order to perform jobs that are not yet included in the scope of obligation by VQA but are included in the Annex-1 list of the mentioned regulation, it is necessary to have a valid vocational training certificate specified inline with the Article 6 of the regulation, as vocational training will be mandatory within the scope of Law No. 6331.
