How Should Annual Leave Request Be Made?

One of the rights regulated in the Turkish Labour Code No. 4857, which is the primary law of Turkish Labour Law, is the right to annual paid leave.

The employee can submit his annual leave request to the employer verbally or in written form. The Turkish Labour Code No. 4857 does not specify any way to request annual leave.

If the employee requests annual leave in writing, it is possible to do so with a petition. This petition can be submitted with wet signature or electronically. In practice, some employers may specify the procedure and format for annual paid leave requests in texts such as “Workplace Internal Regulations” or “Company Policy”. The internal documents of the workplace in question may be decisive regarding how, when and in what way the employee can request annual leave.

It is recommended to receive the annual leave request in writing as evidence in case of possible disputes. It is recommended that the petition regarding the annual leave request contain at least information such as the start date of the leave, the end date of the leave, the type of leave, where the leave will be spent, and the date of request. Likewise, it is possible to add information such as the reason for the leave, the person who will substitute for the job due to his/her absence, the contact information of the substitute worker, and emergency contact information.
