In Turkiye, foreign nationals are subject to permission to work within the country legally. The main legislative text on this subject is the International Labour Code No. 6735 dated 28.07.2016. According to the provisions of the International Labour Code No. 6735, employers who will employ foreigners to work in Turkey are required to obtain a work permit on behalf of the employee before the foreigner starts working.
Work permit is a type of permit issued by the Ministry of Labour and Social Security as an official document and gives the foreigner the right to work and reside in Turkey within its validity period. It is being published in the nature of an ID card.
In accordance with the Code No. 6735, an administrative fine of TRL 22,688 is imposed on a foreigner who works for an employer without a work permit in Turkey for the year 2024. In addition, in accordance with the aforementioned law, an administrative fine of TRL 45,406 is imposed on foreigners who work independently without a work permit.
Likewise, employers who employ foreigners who do not have a work permit will be subject to an administrative fine of TRL 56,752 for each foreigner for the year 2024. An administrative fine of TRL 3,768 is imposed on foreigners working independently and on indefinite leave who do not fulfill their notification obligation stipulated in Code No. 6735 within the prescribed period, and on employers employing foreigners, for each foreigner.
These administrative fines must be paid within one month from their notification. The administrative fines in question are determined by the law as fixed amounts and are increased every year at the Rate of Revaluation.
