Registration of Workplace Transfer in Terms of Social Security

Workplace is the places where the insured do their work together with its material and non-material elements. Places connected to the workplace, which are affiliated with the goods produced or services provided in the workplace and which are organized under the same management and organisation, and the other relevant attachments allocated for doings such as resting, breastfeeding, dining, sleeping, cleaning, examination and care, physical or vocational training places, courtyards and offices, and vehicles are included within the scope of the workplace in accordance with the Turkish Social Security Law.

According to the Turkish social security law, it is obligatory to register workplaces and notify them to the Social Security Institution (SSI). In cases where companies merge, change their types or join another company, and in case of hiring new partners in ordinary companies, an additional workplace notification is required legally.

In case a company which is subject to the provisions of the Turkish Commercial Code No. 6102 change its type, it merges or joins with another company, this has to be notified within then days as to start from the date of the announcement regarding the registration of these matters in the trade registry. In the case of a new partner being recruited to the company in ordinary companies, a notification is supposed to be made with a workplace declaration, at the latest, within ten days following the date of receipt of the new partner.

It is sufficient not to submit a workplace declaration for changes in business name in workplaces, but to notify the SSI with a letter to which the Trade Registry Gazette is attached.

Transactions to be done in case of transfer of workplace

In the event of the transfer of a job or workplace with social insured employment in it, the workplace notification will be sent to the relevant unit of the Institution where the workplace is processed, by the new employer, at the latest, within ten days following the date of transfer of the job or workplace.

In the event of the death of the real person employer, the workplace declaration shall be given to the relevant unit of the SSI where the workplace is processed, by the heirs, within three months at the latest from the date of death.

The workplace file will not be registered separately based on the workplace notification issued due to the transfer, and the necessary changes regarding the transfer will be recorded in the registration logs in order to continue the transactions from the old workplace number.

In case the workplace is transferred from the province in which it operates, the workplace notification shall be given to the unit of the SSI to which the address of the workplace is transferred, within ten days following the date of transfer of the workplace at the latest.

In case the workplace is transferred to the duty area of another unit of the SSI within the same province, a workplace notification is not required to be given. The situation will be notified to the old and new unit by the employer within ten days following the transfer date, and the new workplace file will be registered upon the written notification. The new unit will notify the employer of the workplace registration number based on the transfer information, and a copy of the information and documents based on the registration in the workplace file in the old unit will be placed in the file in the new unit.

In case the workplace is transferred to the address falling within the scope of duty of another unit of the SSI, the situation will be notified in writing to the unit where the old workplace file is located within fifteen days from the date of notification by the new unit, and the old workplace file will be removed from the scope of the Law No. 5510 upon the notification made.

The new workplace file will be registered upon the written notification made due to the workplace declaration issued due to the transfer of the workplace to an address in another province, or due to the transfer of the workplace to the address in the duty area of another unit within the same province.

In case the workplace is transferred to another address within the scope of duty of the same unit of the SSI, the new address will be notified in writing to the unit where the workplace is processed within ten days from the date of transfer of the workplace. In this case, the new workplace file will not be registered.
