Temporary Incapacitation Allowance in Turkey

The term “temporary incapacity for work” is defined as the temporary inability of the social insured to work during the rest period specified in the reports of the physician or medical board authorized by the Social Security Institution in cases of work accident, occupational disease, illness and maternity.

Accordingly, in terms of social insurance, “Temporary Incapacitation Allowance” is defined as the financial aid paid by the Social Security Institution to the insured who is on leave from work accident, occupational disease, sickness and maternity insurance branches for the days he/she is off work.

The implementation of the Temporary Incapacitation Allowance is being made by the Social Security Institution in Turkey.

At What Rates is Temporary Incapacitation Allowance Paid?

Temporary incapacitation allowance is paid for each day to the insured person who is incapacitated due to a work accident or occupational disease, provided that a sick leave report is obtained from the physician or health committees authorized by the Social Security institution.

Temporary incapacitation allowance to be given in case of work accident or occupational disease is calculated as follows:

  • As half of daily earnings in inpatient treatments.
  • For outpatient treatments, two-thirds of daily income.

However, temporary incapacitation allowance is paid to insured persons who are subject to 4/b insurance status (the insured who are working on their own name and behalf), in case of a work accident or occupational disease, during the inpatient treatment or after the inpatient treatment, when they receive a rest report as a requirement of this treatment.

 

What are the conditions to benefit from Temporary Incapacitation Allowance?

Factors such as a certain insurance period, number of premium payment days and age are not included among the conditions for benefiting from temporary incapacitation allowance paid as a result of work accident and occupational disease. If the insured person, whose insurance qualification continues, becomes incapacitated as a result of a work accident or an occupational disease, temporary incapacitation allowance is paid by the Social Security Institution, as to start from the first day of the incapacitation.

However, in order for 4/b insured people and those working intermittently with a service contract in agriculture and forestry to benefit from the temporary incapacitation allowance, all premiums and premium-related debts, including general health insurance, must be paid.

In the temporary incapacitation allowance made from the sickness insurance and the maternity insurance social insurance branches the allowance is being made as to start from the third day of the temporary incapacitation. In other word, the first two rest days are not within the scope of the temporary incapacitation allowance payment.
