Early Retirement Opportunity for Working Mothers Taking Care of Their Disabled Children

In the Turkish Social Insurance Law, some special rights in the form of positive discrimination have been introduced to working mothers who have severely disabled children who need someone else’s care. One of these rights is the ability to earn extra social insurance service days in return for their work and retire early.

This regulation in question is a regulation introduced by the Social Insurance and General Health Insurance Act No. 5510 in 2008, and it is stated that female insured women who request an old-age pension and have a severely disabled child who needs constant care of someone else, will be able to benefit from the provisions passed after the date of entry into force of the Law No. 5510. According to the mentioned law, one quarter of the number of premium payment days is added to the total number of premium payment days of such female employees. In this way, it is possible for an insured female who works 360 days a year to earn an additional 90 days of service.

In addition, for female insured women who request an old-age pension and have severely disabled children who need constant care from someone else, one-fourth of the number of premium payment days that have passed since October 1, 2008, is to be deducted from their retirement age limits. Thus, it is possible for these women to retire at an earlier age and become a pensioner.

Additional premium payment days and reductions in retirement age are subject to the condition that the female insured certifies this situation. The existence of a severely disabled child who requires the constant care of another person will be documented with a medical board report, and this right will be given to female insured for periods after October 1, 2008 within the condition of having a medical board report. If the report is being taken on a later date, the benefits are being provided as to start of the date of the report.

In the event of the death of a severely disabled child or the end of the need for care, an addition to the number of premium payment days and a reduction from the retirement age are available for services from October 1, 2008 until the date of death or the date of the health board report where it is decided that the need for care is eliminated.
