How to get a work permit in Turkey for foreigners?

Work Permit is a permit issued by the Ministry of Labor and Social Security, which gives the foreigner the right to work and reside in Turkey. According to the International Labour Code No. 6735, foreigners must obtain permission before starting dependent or independent work in Turkey.

Work permit types
There are three work permit types are being applied in Turkey. The first of these is a temporary, the second is an indefinite and the last is an independent work permit. Now, let’s look at a little more detail. Let’s find out what these permission types mean.

What is a temporary work permit?
According to the International Labour Code No. 6735, which was published in the Turkish Official Gazette dated 13/8/2016 and numbered 29800, the foreigner whose work permit application is evaluated positively, provided that it does not exceed the duration of the employment or service contract, in a certain workplace belonging to a real or legal person or a public institution or organization. or a work permit for a maximum of one year is given at the first application, provided that the foreigner will be working in a specific job and a specific workplace.

If the work permit extension application is evaluated positively, the foreigner is granted a work permit for a maximum of two years in the first extension application and up to three years in the subsequent extension applications, depending on the same employer. However, applications made to work with a different employer are evaluated within the scope of the first paragraph of the Article 7 of the Code No. 6735.

What is an indefinite work permit?
Foreigners who have a long-term residence permit or a legal work permit for at least eight years in Turkey can apply for an indefinite work permit. However, the foreigner’s fulfillment of the application conditions does not provide an absolute right to the foreigner.

The foreigner with an indefinite work permit benefits from all the rights provided by the long-term residence permit. A foreigner with an indefinite work permit benefits from the rights granted to Turkish citizens, provided that his acquired rights regarding social security are reserved and the use of these rights is subject to the provisions of the relevant legislation, excluding the regulations in special laws.

The foreigner who has an indefinite work permit does not have the right to elect, be elected and to take up public duties, and does not have the obligation to do military service.

What is an independent work permit?
Professional foreigners can be granted an independent work permit, provided that the special conditions specified in other laws are met.

In the evaluation of the independent work permit in line with the international labor policy, the foreigner; education level, professional experience, contribution to science and technology, the impact of his activity or investment in Turkey on the country’s economy and employment, capital share if he is a foreign company partner, and other issues to be determined by the Ministry in line with the recommendations of the International Labor Policy Advisory Board. Independent work permit is issued for a period of time.
