Implementation of the Unemployment Allowance in Turkey

Unemployment allowance is one of the payments in the nature of social insurance made by the General Directorate of the Turkish Employment Agency (İŞKUR) within the scope of the Unemployment Insurance Law No. 4447. Unemployment Allowance refers to the monetary payment made by İŞKUR to insured unemployed people for the period and amount specified in Law No. 4447.

Daily unemployment allowance is forty percent of the insured’s daily average gross earnings, calculated by taking into account the premium-based earnings of the last four months. The amount of unemployment allowance calculated in this way cannot exceed eighty percent of the gross amount of the national monthly minimum wage.

In this context, unemployment allowances vary between 8 thousand Liras and 16 thousand Liras for the calendar year of 2024.

The payment period for unemployment allowance varies depending on the unemployment premium payment period of the insured. Accordingly, among those who were subject to a service contract for the last 120 days before the termination of their service contract, insured unemployed people who worked for 600 days in the last three years and paid unemployment insurance premiums are given 180 days of unemployment allowance. Unemployment allowance is paid for 240 days to insured unemployed people who have worked insured for 900 days and paid unemployment insurance premiums in the last three years before the termination of their service contract, and 300 days of unemployment allowance is paid to unemployed people who have worked insured for 1080 days and paid unemployment insurance premiums.

Unemployment allowances are paid to the unemployed person on a monthly basis, on the fifth of each month. The Minister of Labour and Social Security is authorized to bring forward the payment date. Unemployment allowance is not subject to any taxes or deductions except stamp duty. Except for alimony debts, it cannot be seized or transferred or assigned to anyone else.

Overpayments determined to be due to the fault of the insured are refunded with legal interest. Overpayments of deceased insured unemployed people are not collected back.

If the insured person re-employs before completing the unemployment allowance period and becomes unemployed again without fulfilling the conditions stipulated by the Law No. 4447 in order to benefit from unemployment insurance allowance, he/she will continue to benefit from this right until he/she completes the unemployment allowance period to which he/she was previously entitled. In case of becoming unemployed again by fulfilling the conditions stipulated by the Law No. 4447, unemployment allowance is paid only for the period arising from this new entitlement.
