Notification of Work Accidents and Legal Obligations in Turkey

Work accident notification constitutes one of the obligations on the employers and enterprises which are oeprating in Turkey. It is obligatory to notify the accidents that the insured has suffered at the workplace, due to the work he/she is working at, or during the performance of other work given by the employer, or in other situations specified in the law, and which cause the insured to be temporarily or permanently disabled as to show effect immediately or later.

 

Deadline for Work Accident Notifications

In terms of insurance holders working under an employer, it is obligatory to report an occupational accident to the authorized law enforcement officers (police forces or gendarme forces) of that place immediately and to the Social Security Institution within three working days after the accident at the latest. The three-day period should be calculated as work days (excluding Saturday and Sunday and official holiday days), not as calendar days, starting from the day after the accident.

In Turkey, the sole authority to make notifications of work accidents is the Social Security Institution. Making the notification with the form named “Occupational Accident and Occupational Disease Notification Form” is also a formal condition.

Online Notification of Work Accidents

The Occupational Accident and Occupational Disease Notification form can be accessed online from the aforementioned link.

 

In case the occupational accident notification is not made within the legal period or not at all, an administrative fine is imposed on the employer in accordance with the Occupational Health and Safety Law Code No. 6331.

The amount of administrative fine to be applied varies according to the hazard class of the workplace and the number of employees working in the workplace. This penalty is to be applied between TRL 5,224 and TRL 15,672 for the calendar year of 2022 per accident case.

The employer is obliged to pay this penalty. In case of non-payment, enforcement proceedings will be initiated by the Social Security Institution and payment will be made through forced execution.
